A good rule of thumb is if you had to pay for it otherwise and get it for free, then it’s illegal. Video games, commercial music, movies, etc., and some software fall into this category.
Sometimes you’ll be tricked- some sites say ‘download free legal music’; you pay $30 for a clien to download music, but all you’re actually doing is paying the site for a download link to a freely available (or custom) client to illegally download the same stuf you could for free.
Most GNU GPL (GNU General Public License) or Creative Commons license content is free It will usualyl state this right on the site you’re trying to download from.

If someone has done that, is it ethical and legal for you to download it? Is it ethical for an internet site to host programs that enable people to “jailbreak” – illegally modify the software – of their iPhone? Is that illegal, or is the site free from having to determine what kind of applications/blogs/music/videos are posted there?

@Ed Fox: There are plenty of legal uses for BitTorrent. World of Warcraft delivers is patches via the BitTorrent protocol as does Final Fantasy XIV. I’d say the majority of torrents are pirated movies, music, and software so I can see why you’d think that.
